Welcome to Famely! By using our service, you agree to these terms. Please read them carefully.

1. Agreement to Terms

•By accessing or using Famely, you agree to be bound by these Terms of Service and our Privacy Policy.
•If you do not agree to these Terms, you must not access or use Famely.
•These Terms constitute a legally binding agreement between you and Famely.
•We may update these Terms at any time, and your continued use of Famely after such updates constitutes acceptance of the revised Terms.

2. Eligibility & Account Terms

•Age Requirement: You must be at least 16 years old to use Famely. By using Famely, you represent and warrant that you meet this age requirement.
•You are responsible for maintaining the confidentiality and security of your account credentials.
•You are solely responsible for all content posted and all activity that occurs under your account, whether or not authorized by you.
•One person or legal entity may maintain only one account. Creating multiple accounts may result in termination of all accounts.
•You may not use Famely for any illegal, unauthorized, or harmful purpose.
•You must provide accurate, current, and complete information during registration and keep your account information updated.

3. Acceptable Use

•Be Authentic: Use your real identity and provide accurate information. Impersonation is prohibited.
•Be Respectful: Do not harass, bully, threaten, or intimidate other users.
•No Spam: Do not post repetitive, misleading, or unsolicited promotional content.
•No Harmful Content: Do not share content that promotes violence, discrimination, self-harm, or illegal activities.
•Respect Privacy: Do not share others' personal information without their explicit consent.
•Follow Laws: Comply with all applicable local, national, and international laws and regulations.
•No Manipulation: Do not attempt to manipulate Famely's systems, including the Spotlight selection algorithm.

4. Automation & Technical Restrictions

•You may not use bots, scrapers, crawlers, or other automated means to access, collect data from, or interact with Famely without our prior written consent.
•You may not attempt to probe, scan, or test the vulnerability of Famely's systems or networks.
•You may not interfere with, disrupt, or create an undue burden on Famely or the networks connected to Famely.
•You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of Famely.
•You may not circumvent, disable, or otherwise interfere with security-related features of Famely.
•Violation of these restrictions may result in immediate account termination and may be reported to law enforcement authorities.

5. Profile Review

•All profiles are subject to review before appearing for other users on the platform.
•We reserve the right, at our sole discretion, to reject, remove, or suspend any profile that violates our guidelines or these Terms.
•Profile rejection or removal does not entitle you to any refund if paid features were purchased.
•Updating your profile automatically triggers a review before changes become publicly visible.
•Review decisions are made at our sole discretion to maintain community standards and user safety.
•We are under no obligation to provide reasons for rejection, though we may do so at our discretion.

6. Spotlight Feature

•The Spotlight feature uses a weighted random selection algorithm to choose users from the pool of approved profiles at regular intervals.
•Your selection weight is determined by factors including your invite tier — inviting friends increases your boost multiplier, giving you higher chances of being selected.
•Selection remains random and probabilistic; having a higher boost increases your probability relative to other users but does not guarantee selection.
•You may opt out of Spotlight selection at any time through your profile settings.
•Being in the Spotlight means your profile is prominently visible to all users during that interval.
•We reserve the right to remove any user from the Spotlight at any time, for any reason, without notice.
•We may modify, suspend, or discontinue the Spotlight feature at any time without liability to you.

7. Prohibited Content

•Nudity, pornography, or sexually explicit or suggestive content
•Violence, gore, graphic imagery, or content depicting abuse
•Hate speech, discrimination, or harassment based on any protected characteristic
•Impersonation of others, fake identities, or misleading representations
•Spam, scams, phishing attempts, or fraudulent schemes
•Content that infringes on intellectual property rights, including copyright and trademarks
•Malware, viruses, harmful code, or links to malicious websites
•Content promoting illegal activities, drugs, weapons, or dangerous substances
•Content that exploits or endangers minors in any way
•Any content that violates applicable laws or regulations

8. Intellectual Property & Content License

•Your Ownership: You retain ownership of original content you create and post on Famely.
•License to Famely: By posting content, you grant Famely a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your content in connection with operating and promoting Famely.
•Marketing Rights: You grant Famely the right to use your username, profile picture, and publicly posted content in promotional and marketing materials, both on and off the platform.
•Content Retention: Upon account deletion, we may retain your content for up to 90 days for operational, legal, and safety purposes, after which it will be permanently deleted unless retention is required by law.
•Respect Others: You may not copy, modify, distribute, or use content from other users without their explicit permission.
•Our IP: The Famely name, logo, branding, software, and all associated intellectual property are owned by Famely and protected by applicable laws.
•Report intellectual property violations to famelydevelopment@gmail.com.

9. Third-Party Links & Services

•Famely allows you to link to third-party social media platforms and websites. These links are provided for your convenience only.
•We do not control, endorse, or assume responsibility for any third-party websites, platforms, or services linked from Famely.
•Your use of third-party services is governed by their respective terms and privacy policies.
•We are not liable for any damages or losses arising from your use of or reliance on third-party services.
•The inclusion of any link does not imply affiliation with or endorsement by Famely.
•You are solely responsible for ensuring that your linked content complies with both our Terms and the terms of the third-party platforms.

10. Service Modifications & Virtual Items

•We reserve the right to modify, update, suspend, or discontinue any part of Famely (including any feature, functionality, or content) at any time, with or without notice.
•The Service may include virtual items, including but not limited to "Boosts" and "Badges" (collectively, "Virtual Items"). Virtual Items have no monetary value, cannot be exchanged for cash, and are not your property.
•We reserve the absolute right, at our sole discretion, to manage, regulate, control, modify, or eliminate Virtual Items as we see fit.
•This includes the right to modify how Virtual Items are earned or obtained, and to revoke, adjust, or remove Virtual Items already acquired by or distributed to your account, without compensation.
•You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service or for any changes to Virtual Items.
•Any future paid features, subscriptions, or purchases will be subject to additional terms that will be provided at the time of purchase.

11. Account Termination

•By You: You may delete your account at any time through your account settings or by contacting us.
•By Us: We may suspend or terminate your account immediately, without prior notice or liability, if you violate these Terms or for any other reason at our sole discretion.
•Upon termination, your right to use Famely ceases immediately, and your profile will be removed from the Spotlight pool and search results.
•We may retain certain information as required by law, for legitimate business purposes, or to enforce our rights.
•Termination does not affect any rights, obligations, or liabilities that accrued prior to termination.
•Following termination, provisions of these Terms that by their nature should survive will remain in effect (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability).

12. Disclaimers

•Famely is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
•We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
•We do not warrant that Famely will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
•We do not guarantee any specific results from your use of Famely, including but not limited to follower growth, visibility, or engagement.
•We are not responsible for the accuracy, reliability, or completeness of any content posted by users.
•We are not responsible for any interactions, disputes, or relationships between users.
•Your use of Famely is entirely at your own risk.

13. Limitation of Liability

•To the maximum extent permitted by applicable law, Famely and its operator shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses.
•Our total aggregate liability to you for all claims arising from or relating to Famely shall not exceed the greater of (a) the amount you paid to Famely in the 12 months preceding the claim, or (b) €100.
•These limitations apply regardless of the legal theory upon which the claim is based, including breach of contract, tort, strict liability, or any other theory.
•Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

14. Indemnification

•You agree to indemnify, defend, and hold harmless Famely, its operator, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:
•• Your access to or use of Famely
•• Your violation of these Terms
•• Your violation of any rights of any third party, including intellectual property rights or privacy rights
•• Any content you post, upload, or share on Famely
•• Any interactions you have with other users
•We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims.

15. Governing Law & Jurisdiction

•These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.
•Famely is operated from Finland and is intended for a global audience. We make no representations that Famely is appropriate or available for use in all locations.
•If you access Famely from outside Finland, you do so at your own initiative and are responsible for compliance with local laws.
•For users in the European Union, nothing in these Terms affects your statutory consumer rights under applicable EU law.
•Any disputes arising from these Terms or your use of Famely that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Helsinki, Finland.
•Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction.

16. Dispute Resolution

•Informal Resolution: Before initiating any formal dispute proceedings, you agree to first contact us at famelydevelopment@gmail.com and attempt to resolve the dispute informally for at least 30 days.
•Good Faith Negotiation: Both parties agree to negotiate in good faith to resolve any dispute, controversy, or claim arising out of or relating to these Terms.
•Mediation: If informal resolution fails, either party may propose mediation before a mutually agreed mediator. Mediation costs shall be shared equally.
•Court Proceedings: If mediation is unsuccessful or declined, disputes shall be resolved by the courts of Helsinki, Finland, as specified in Section 15.
•Time Limitation: Any claim or cause of action arising from your use of Famely must be filed within one (1) year after the claim arose, or be permanently barred.
•Class Action Waiver: To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. General Provisions

•Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Famely regarding your use of our services and supersede all prior agreements.
•Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
•No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Famely.
•Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
•Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, internet failures, or pandemics.
•Notices: We may provide notices to you via email, in-app notification, or by posting on Famely. Notices to us should be sent to famelydevelopment@gmail.com.
•Relationship: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Famely.
•Headings: Section headings are for convenience only and have no legal effect.

18. Changes to Terms

•We reserve the right to modify these Terms at any time at our sole discretion.
•For significant changes, we will provide notice via email to the address associated with your account and/or through a prominent in-app notification at least 14 days before the changes take effect.
•Minor changes (such as clarifications or corrections) may be made without prior notice.
•Your continued use of Famely after the effective date of any changes constitutes your acceptance of the updated Terms.
•If you do not agree to the updated Terms, you must stop using Famely and may delete your account.
•The "Last Updated" date at the top of these Terms indicates when they were most recently revised.
